User Agreement (Terms of Service)

I. Scope of Application

Welcome to BluChaCha (hereinafter referred to as “the Application”).

This User Agreement (Terms of Service) (hereinafter referred to as “this Agreement”) is entered into between you and the Application regarding your downloading, installation, access, or use of the Application and its related functions.

By downloading, installing, registering, accessing, or using the Application, you are deemed to have read, understood, and agreed to all the contents of this Agreement. If you do not agree to this Agreement, please immediately stop using the Application.

II. Product Function Description

Based on current product capabilities, this application primarily provides the following short-range communication functions:

• Discover nearby devices via Bluetooth

• Create or join nearby chat rooms

• Send and receive text messages

• Conduct short-range voice communication

• Conduct short-range video communication

• Share location information within a conversation

The core capability of this application is currently based on Bluetooth Short-Range Direct. The availability of some functions may be affected by device model, system version, Bluetooth status, authorization permissions, signal environment, and the status of participating devices.

III. User Qualifications and Account Description

1. User Qualifications

You must possess the civil capacity appropriate to the civil acts you are performing. If you are a minor, you should use this application under the guidance and consent of your guardian.

2. Account and Identity Description

Based on the current project implementation, this application does not currently rely on the traditional internet account system. You can set your nickname, room name, room password, and other conversation information during use.

You should ensure that the nickname, room name, and message content you set or use do not infringe upon the legitimate rights and interests of others, or violate laws, regulations, or public order and good morals.

IV. Permissions and Device Requirements

You understand and agree that, to achieve the corresponding functions, this application may require the following permissions:

• Bluetooth permission
• Microphone permission
• Camera permission
• Location permission (for location sharing)

If you refuse to grant the relevant permissions, some functions will not function properly.

You should also ensure that:

• Your device’s Bluetooth is enabled

• Your device has the necessary audio, video, and positioning capabilities

• The usage environment complies with laws, regulations, and public safety requirements

V. User Conduct Guidelines

When using this application, you must not engage in the following behaviors:

• Posting, transmitting, or sharing any illegal, harmful, insulting, defamatory, harassing, obscene, violent, or other inappropriate content

• Impersonating another person or forging session information

• Using this application to infringe upon another person’s privacy, portrait rights, reputation rights, intellectual property rights, or other legitimate rights

• Recording, disseminating, or publicly displaying another person’s voice, video, location, or chat content without consent

• Interfering with, disrupting, or attempting to bypass this application, system, device, or Bluetooth connection mechanism

• Using this application to engage in any illegal or criminal activities or activities that endanger national or public safety

• Reverse engineering, decompiling, cracking, tampering with, or performing other technical operations on this application beyond the scope permitted by law

VI. Regarding Chat, Audio/Video, and Location Sharing

You understand and agree that:

• You are solely responsible for any content you send, share, display, or disseminate

• You should ensure that you have the right to share relevant content and have obtained the necessary authorization or consent.

• Other participants in the session may see your nickname, text messages, voice, video, or location-shared content.

You shall be solely responsible for any disputes, complaints, claims, penalties, or losses arising from the content you upload, share, or disseminate; you shall also be liable for compensation according to law if the application or third parties suffer losses.

VII. Service Changes, Interruptions, and Termination

We reserve the right to adjust the functions, interface, permissions, availability, or support methods of this application based on business arrangements, technical conditions, legal requirements, or security needs.

We may interrupt, restrict, or terminate all or part of the service under the following circumstances:

• System maintenance, upgrades, troubleshooting

• Device or operating system limitations

• Legal, regulatory, policy requirements, or regulatory orders

• Your violation of this agreement

• To protect the legitimate rights and security of the application, other users, or third parties

You understand that, given the strong dependence of Bluetooth, audio/video, and location functions on the system environment, we do not guarantee that the service will always be continuous, stable, uninterrupted, or error-free.

VIII. Intellectual Property

The intellectual property rights of this application and its related content, including but not limited to software, interface design, icons, logos, text, technical documentation, and other content, belong to this application or the relevant rights holders in accordance with the law.

Without written permission, you may not:

• Copy, modify, distribute, rent, lend, or sell this application or any part thereof

• Use the application’s logos for misleading advertising

• Infringe upon our or any third party’s intellectual property rights in any other way

IX. Disclaimer

To the maximum extent permitted by applicable law, this application is provided on an “as is” and “as available” basis.

We make no guarantees regarding the following:

• This application is completely error-free, uninterrupted, or absolutely secure.

• Bluetooth connectivity, voice, video, and location sharing are stable and usable in any environment.

• This application is fully compatible with any third-party devices, system versions, or external environments.

We will not be liable for or will limit our liability to the extent permitted by law for losses caused by the following:

• Device malfunction, system restrictions, disabled permissions, Bluetooth abnormalities, or signal interference.

• Improper user operation.

• Force majeure or external causes beyond our control.

• Losses caused by the actions of third parties.

Where mandatory provisions of law apply, those provisions shall prevail.

X. Privacy and Personal Information Protection

The rules governing the processing of your personal information when using this application are governed by the Privacy Policy. This policy constitutes an important part of this agreement.

XI. Applicable Law and Dispute Resolution

The formation, effectiveness, interpretation, performance, and dispute resolution of this agreement shall be governed by the laws of the People’s Republic of China; where mandatory provisions of the laws of your region apply, those mandatory provisions shall apply to the extent that they do not conflict with the foregoing laws.

Any dispute arising from this Agreement or this Application shall be resolved amicably through negotiation between the parties. If the negotiation fails, either party may file a lawsuit in the People’s Court with jurisdiction in the location of this Application, or resolve the dispute through other means permitted by law.

XII. Agreement Updates

We reserve the right to adjust the content of this Agreement in accordance with business development, legal requirements, or regulatory policies. The updated Agreement will be published on the appropriate page or channel and will take effect from the date of publication or statement.

Your continued use of this Application after the update constitutes your acceptance of the updated Agreement.
